Commercial air conditioning is rarely just about comfort. Downtime can stop a server room, a kitchen, or a shop floor, and any system using refrigerant puts a legal duty on you as the operator under the Fluorinated Greenhouse Gases Regulations 2015, with larger systems also needing a TM44 inspection by law.

Commercial air conditioning must be kept efficient, reliable, and legally compliant. Under the Fluorinated Greenhouse Gases Regulations 2015, any work on the refrigerant circuit must be done by an F-Gas certified engineer. Systems over 12kW also need a TM44 inspection at least every five years. Most commercial systems are serviced yearly as a baseline.
Your legal obligations for commercial air conditioning
Commercial air conditioning is subject to two main compliance regimes, and both put the legal duty on you as the building owner or operator, not on the engineer who attends.
F-Gas: the Fluorinated Greenhouse Gases Regulations 2015
Almost all air conditioning uses fluorinated refrigerant, which brings it within the Fluorinated Greenhouse Gases Regulations 2015 (as amended in 2022). Any work on the refrigerant circuit, including servicing, leak checking, and refrigerant recovery, must be carried out by an F-Gas certified engineer. Systems above a set refrigerant charge must also be leak-checked at intervals fixed by that charge, measured in tonnes of CO₂ equivalent:
- 5 tonnes CO₂e or more: leak check at least every 12 months
- 50 tonnes CO₂e or more: at least every 6 months
- 500 tonnes CO₂e or more: at least every 3 months, with fixed automatic leak detection required
Automatic leak detection doubles the interval, and records must be kept for at least five years. Robinsons Facilities Services is REFCOM registered, the recognised F-Gas registration scheme, so this work is carried out and documented correctly.
TM44 inspections for systems over 12kW
If your building has air conditioning with a combined cooling output of more than 12kW, you must have a TM44 inspection carried out by an accredited energy assessor at least every five years, under the Energy Performance of Buildings (England and Wales) Regulations 2012. Several small units controlled by one person count towards the 12kW threshold, and a building without a valid report faces a £300 penalty.

There is no blanket law requiring every unit to be serviced annually. However, if a system holds 5 tonnes CO₂e or more of refrigerant, you have a legal duty as the operator to have it leak-checked at least annually by a certified engineer and to keep the records for five years. Annual servicing is also normally required to keep the manufacturer warranty valid, so most commercial systems are serviced yearly.
